The Korean patent system is characterized by
- First-to-file Rule,
- Request for substantive examination, within 3 years from filing date
- Utility Model system (Duration of Right: 10 years).
(1) Applicant
- The inventor and the assignee can file a patent application with KIPO (Korean Intellectual Property Office)
(2) Documents Required
- Applicant’s name, address and inventor’s name, address.
- Title of invention, detailed description, claim(s)
- drawing(s), if any
- POA (Power of Attorney)
(3) Claim of Priority
- Applicant can claim of Priority, if he(she) files the application within 1 year from the date of the priority application.
(4) Request of Examination
- A patent application is going to be examined upon a request for examination. The applicant should request for examination within 3 years from the filing date. If not, the patent application id deemed to have been withdrawn.
