South Korean Design application system has a 2 examination systems, the first is the Substantive Examination System and the second is the Partial-Substantive Examination System. The both are depending on the Locarno Classes of the design articles.
(1) Applicant
- The designer and the assignee can file a design application with KIPO (Korean Intellectual Property Office)
(2) Documents Required
- Applicant’s name, address and designer’s name, address.
- Title of design article, brief description
- drawings (perspective, front, rear, right side, left side, top, bottom views)
- POA (Power of Attorney)
(3) Claim of Priority
- Applicant can claim of Priority, if he(she) files the application within 6 months from the date of the priority application.
(4) Examination
- Design application is automatically taken up for examination in the order of the filing date. Therefore, a request of examination is not required for substantive examination.
